1 A bill to be entitled
2 An act relating to tattooing; amending s.
3 877.04, F.S.; providing requirements regarding
4 the tattooing of minors; requiring a review of
5 the need for regulation of the tattooing
6 industry to be conducted; providing an
7 effective date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Subsection (3) of section 877.04, Florida
12 Statutes, is amended to read:
13 877.04 Tattooing prohibited; penalty.--
14 (1) It is unlawful for any person to tattoo the body
15 of any human being; except that tattooing may be performed by
16 a person licensed to practice medicine or dentistry under
17 chapters 458 and 459 or chapter 466, or by a person under his
18 or her general supervision as defined by the Board of
19 Medicine.
20 (2) Any person who violates the provisions of this
21 section shall be guilty of a misdemeanor of the second degree,
22 punishable as provided in s. 775.082 or s. 775.083.
23 (3) No body of a minor shall be tattooed without the
24 written notarized consent of the parent or legal guardian. The
25 body of a minor under the age of 16 may not be tattooed unless
26 the minor is accompanied by a parent or legal guardian.
27 Section 2. Tattoo industry sunrise review
28 provisions.--It is the intent of the Legislature that no
29 profession or occupation be subject to regulation by the state
30 unless the regulation is necessary to protect the public
31 health, safety, or welfare from significant and discernible

1 harm or damage. Therefore, pursuant to section 11.62, Florida
2 Statutes, a review shall be conducted to determine the need to
3 regulate the tattooing industry. The recommendations of the
4 review shall be submitted to the Legislature on or before
5 February 1, 2001. The proponents of this regulation and the
6 agency of jurisdiction shall assist in conducting the review.
7 Section 3. This act shall take effect July 1, 2000.

10 SENATE SUMMARY
11 Prohibits the tattooing of a minor who is under the age
of 16 years unless the minor is accompanied by a parent
12 or legal guardian. Requires a review of the need to
regulate the tattooing industry. Requires the
13 recommendations resulting from the review to be submitted
to the Legislature by February 1, 200l.
