  1                      A bill to be entitled

  2         An act relating to motor vehicle dealerships;

  3         creating the "Florida Motor Vehicle Dealership

  4         Act of 2000"; amending s. 320.645, F.S.;

  5         providing that restrictions on the ownership of

  6         a motor vehicle dealership by a licensee shall

  7         not apply to certain licensees; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Short title.--This act may be cited as the

13  "Florida Motor Vehicle Dealership Act of 2000."

14         Section 2.  Subsection (3) is added to section 320.645,

15  Florida Statutes, to read:

16         320.645  Restriction upon ownership of dealership by

17  licensee.--

18         (3)  This section shall not apply to a licensee that

19  owns or operates motor vehicle dealerships of the same

20  line-make franchised by the licensee, provided that each of

21  the following conditions are met:

22         (a)  All of the licensed locations for the sale of such

23  licensee's new motor vehicles in this state trade exclusively

24  in the licensee's line-make.

25         (b)  During any period in which the licensee has an

26  ownership interest, said licensee has no more than 18 motor

27  vehicle franchises within this state.

28         (c)  All of the licensee's franchise agreements confer

29  rights on the franchisee of the line-make to develop and

30  operate, within a defined geographic territory or area, as

  1  many dealership facilities as the franchisee and licensee

  2  shall agree are appropriate.

  3         (d)  At the time the licensee first acquires an

  4  ownership interest, not fewer than one-half of the franchises

  5  of the line-make within this state own and operate two or more

  6  dealership facilities in the geographic territory or area

  7  covered by the franchise agreement with the licensee.

  8         Section 3.  This act shall take effect upon becoming a

  9  law.

15    dealership by a licensee to permit described licensees to
