1 A bill to be entitled
2 An act relating to environmental protection;
3 requiring the Department of Environmental
4 Protection to conduct a study relating to the
5 use of MTBE in the state and to report its
6 findings and recommendations to the
7 Legislature; requesting participation by the
8 petroleum industry in the study; providing an
9 effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. The Department of Environmental Protection,
14 in consultation with representatives of the petroleum
15 industry, shall conduct a study of the effects and
16 consequences of use of the gasoline additive MTBE in this
17 state, the areas of concern resulting from the use of MTBE,
18 the alternatives to MTBE, and the effects and consequences of
19 using an alternative to MTBE. The study must take into account
20 the results of the federal Environmental Protection Agency's
21 Blue Ribbon Panel study on the topic, determine the
22 applicability of those results, and determine the actions that
23 this state needs to undertake. The department shall submit to
24 the Legislature by January 15, 2001, a report containing the
25 results of its study and the department's recommended
26 legislation, if any. The Legislature requests that the
27 petroleum industry participate to the extent practicable with
28 the department in the conduct of the study.
29 Section 2. This act shall take effect upon becoming a
30 law.

COMMITTEE SUBSTITUTE FOR

4 The committee substitute makes the following changes:
5 * Requires the Department of Environmental Protection
(DEP) to conduct a study of the effects and consequences
6 of using MTBE as a gasoline additive.
7 * Provides the study will include areas of concern
resulting from the use of MTBE, the alternatives to
8 MTBE, and the effects and consequences of using an
alternative to MTBE.

* Requires the study to take into account the results of
10 the federal Environmental Protection Agency's Blue
Ribbon Panel study on MTBE, determine its applicability,
11 and the actions Florida needs to undertake.
12 * Requires DEP to submit a report of the results of its
study to the Legislature by January 15, 2001, together
13 with any recommended legislation.
14 * Requests the petroleum industry's participation in the
study to the extent practicable.
