1 A bill to be entitled
2 An act relating to towed vehicles; requiring
3 persons who tow or otherwise remove motor
4 vehicles to notify the local law enforcement
5 agency; providing notification requirements;
6 requiring the law enforcement agency to enter
7 such information in the state FCIC/NCIC
8 computer system; requiring law enforcement
9 agencies to inquire into the reported theft or
10 recovery of vehicles or certain vehicle
11 identification information and requiring them
12 to enter such information into the state
13 FCIC/NCIC computer system; providing an
14 effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. (1) Any person that tows, repossesses, or
19 otherwise removes a vehicle from public or private property,
20 without the owner or lessee, or his or her agent present,
21 shall, within 30 minutes after removing the vehicle, notify
22 the police or, in an unincorporated area, the sheriff, of the
23 time of the removal; the storage or delivery site; the make,
24 model, color, license plate, and vehicle identification number
25 of the vehicle; and the reason for the removal, and shall
26 obtain the name of the person at the agency to whom such
27 information was reported and note the name on the trip record.
28 (2) The law enforcement agency that receives
29 notification of such removal shall immediately enter the
30 vehicle identification information by electronic communication
31 into the state FCIC/NCIC computer system.

1 Section 2. (1) When a law enforcement agency is
2 notified that a vehicle, license plate, registration decal, or
3 a vehicle vin plate has been stolen or recovered, the agency
4 shall make due and diligent inquiry into the circumstance of
5 the reported theft or recovery, or shall immediately refer the
6 person reporting such information to the law enforcement
7 agency having jurisdiction over the place where the item was
8 removed or recovered.
9 (2) Upon notification of such theft or recovery, the
10 law enforcement agency that has jurisdiction over the place
11 where the item was removed or recovered shall immediately
12 enter the information by electronic communication into the
13 state FCIC/NCIC computer system.
14 Section 3. This act shall take effect July 1, 2000.

17 SENATE SUMMARY
18 Requires persons who tow or otherwise remove motor
vehicles to notify the local law enforcement agency.
19 Requires the law enforcement agency to enter such
information into the state FCIC/NCIC computer system and
20 also requires local law enforcement agencies to enter
information about reported stolen or found motor vehicles
21 or certain motor vehicle identification into that
computer system.
