16 insert:
17 Section 45. (1) The Correctional Privatization
18 Commission created under chapter 957, Florida Statutes, in
19 consultation with the Department of Children and Family
20 Services, shall develop and issue a request for proposal for
21 the financing, design, construction, acquisition, ownership,
22 leasing, and operation of a secure facility of at least 400
23 beds to house and rehabilitate sexual predators committed
24 under the Jimmy Ryce Act of 1998. The Secretary of Children
25 and Family Services shall retain final approval of the request
26 for proposal, the successful bidder, and the contract.
27 (2) This constitutes specific legislative
28 authorization for the Correctional Privatization Commission to
29 enter into a contract with a provider for the financing,
30 design, construction, acquisition, ownership, leasing, and
31 operation of a secure facility to house and rehabilitate

1 sexual predators, to be constructed upon the grounds of the
2 DeSoto Correctional Facility in DeSoto County which houses the
3 Desoto Correctional Institute.
4 (3) The selected contractor for the financing, design,
5 construction, acquisition, ownership, leasing, and operation
6 of the secure facility is authorized to enter into a lease
7 arrangement or other private financing, or to sponsor the
8 issuance of tax-exempt bonds, certificates of participation,
9 or other public or private means to finance the facility. The
10 department is authorized to enter into all such agreements as
11 are necessary, including lease alternatives, to bring the
12 facility to an operational state and to commence leasing of
13 the facility.
14 (4) Upon completion of the secure treatment facility
15 in DeSoto County for sexual predators, the Martin Sexually
16 Violent Predator Treatment and Retaining Program shall be
17 phased out, to be terminated within 1 year after completion of
18 the facility.
