13         Senate Amendment (with title amendment) 

14         On page 77, before line 1,

15

16  insert:

17         Section 45.  Residential Group Care Placements.--

18         (1) Subject to a specific appropriation,  the

19  Department of Children and Family Services shall contract for

20  residential group care placements:

21         (a) In Districts 6, 7, 13, and 14 in order to eliminate

22  the placement of more than five children per foster home and,

23         (b) On a statewide basis when there is no appropriate

24  foster care placement available for a child with special

25  needs. For the purposes of this section, a "child with special

26  needs" means a child with a learning or developmental

27  disability or a chronic physical, medical, or emotional

28  condition.

29         Standard board and care rates shall be established and

30  uniformly applied by the Department of Children and Family

31  Services.

 1         (2) The Department of Children and Family Services must

 2  submit a report to the President of the Senate and the Speaker

 3  of the House of Representatives by October 1, 2001, any

 4  difficulties with contracting for these placements because of

 5  a facility shortage or limited provider capacity.  Included in

 6  the report, the department shall recommend solutions to any

 7  problems contracting for placements and shall recommend

 8  expansion to one or more districts beyond the four districts

 9  identified in (1), providing the reasons for recommending the

10  selected districts and the associated costs.

11         (3) The sum of $12,700,000 is appropriated from the

12  General Revenue Fund and $6,300,000 is appropriated from the

13  Federal Grants Trust Fund to the Department of Children and

14  Family Services to contract for residential group care

15  placements as provided in (1) and (2).  No less than 3 million

16  dollars shall be spent on residential group care placements

17  for children with special needs.

18         (4)  This act shall take effect upon becoming a law.
