18 Section 4. Section 393.502, Florida Statutes, is
19 amended to read:
20 393.502 Family care councils.--
21 (1) CREATION; APPOINTMENT.--There shall be established
22 and located within each service district of the department of
23 Children and Family Services a district family care council.
24 (2) MEMBERSHIP.--
25 (a) Each district family care The council shall
26 consist of at least 10 and no more than 15 members nine
27 persons recommended by a majority vote of the district family
28 care council and appointed by the Governor district health and
29 human services board.
30 (b) At least three One-half of the members of the
31 council must be consumers. One such member shall be a consumer

1 who received developmental services within the 4 years prior
2 to the date of recommendation, or the legal guardian of such a
3 consumer. The remainder of the council members shall be
4 parents, guardians, or siblings who are family members or
5 legal guardians of persons with developmental disabilities who
6 qualify for developmental services pursuant to this chapter.
7 At least one-half of the members of the council shall be
8 current consumers of developmental services.
9 (c) A person who is currently serving on another board
10 or council of the department may not be appointed to a
11 district family care council.
12 (d) Employees of the department are not eligible to
13 serve on a district family care council.
14 (e) Persons related by consanguinity or affinity
15 within the third degree shall not serve on the same district
16 family care council at the same time.
17 (f) A chair chairperson for the council shall must be
18 chosen by the council members to serve for 1 year. A person
19 may serve no more than four 1-year terms as chair.
20 (3) TERMS; VACANCIES.--
21 (a) Council members shall be appointed for a 3-year
22 2-year term, except as provided in subsection (8), and may be
23 reappointed to not more than one additional term. A person who
24 is currently serving on another board or council of the
25 department may not be appointed to a family care council.
26 (b) A member who has served two consecutive terms
27 shall not be eligible to serve again until 12 months have
28 elapsed since ending his or her service on the district
29 council.
30 (c) Upon expiration of a term or in the case of any
31 other vacancy, the district council shall, by majority vote,

1 recommend to the Governor for appointment a person for each
2 vacancy. If the Governor does not act on the council's
3 recommendations within 45 days after receiving them, the
4 persons recommended shall be considered to be appointed.
5 (4) COMMITTEE APPOINTMENTS.--The chair of the district
6 family care council may appoint persons to serve on council
7 committees. Such persons may include former members of the
8 council and persons not eligible to serve on the council.
9 (5) TRAINING.--
10 (a) The department, in consultation with the district
11 councils, shall establish a training program for district
12 family care council members. Each district shall provide the
13 training program when new persons are appointed to the
14 district council and at other times as the secretary deems
15 necessary.
16 (b) The training shall assist the council members to
17 understand the laws, rules, and policies applicable to their
18 duties and responsibilities.
19 (c) All persons appointed to a district council must
20 complete this training within 90 days after their appointment.
21 A person who fails to meet this requirement shall be
22 considered to have resigned from the council.
23 (6)(2) MEETINGS; CONTINUED EXISTENCE.--Council members
24 shall serve on a voluntary basis without payment for their
25 services but shall be reimbursed for per diem and travel
26 expenses as provided for in s. 112.061. The council shall
27 meet at least six times per year once a month.
28 (7)(3) PURPOSE.--The purpose of the district family
29 care councils shall be to advise the health and human services
30 boards of the department and its district advisory boards, to
31 develop a plan for the delivery of developmental services

1 family support within the district, and to monitor the
2 implementation and effectiveness of services and support
3 provided under the plan. The primary functions of the
4 district family care councils shall be to:
5 (a) Assist in providing information and outreach to
6 families.
7 (b) Review the effectiveness of developmental services
8 programs and make recommendations with respect to program
9 implementation.
10 (c) Advise district developmental services
11 administrators with respect to policy issues relevant to the
12 community and family support system in the district.
13 (d) Meet and share information with other district
14 family care councils.
15 (8) NEW COUNCILS.--When a district family care council
16 is established for the first time in a district, the Governor
17 shall appoint the first four council members, who shall serve
18 3-year terms. These members shall submit to the Governor,
19 within 90 days after their appointment, recommendations for at
20 least six additional members, selected by majority vote. If
21 the Governor does not act on the recommendations within 45
22 days after receiving them, the persons recommended shall be
23 considered to be appointed. Those members recommended for
24 appointment by the Governor shall serve for 2 years.
25 (9) FUNDING; FINANCIAL REVIEW.--The district family
26 care council may apply for, receive, and accept grants, gifts,
27 donations, bequests, and other payments from any public or
28 private entity or person. Each district council shall be
29 subject to an annual financial review by district staff
30 assigned by the district administrator. Each district council
31 shall exercise care and prudence in the expenditure of funds.
