  1                      A bill to be entitled

  2         An act relating to property insurance;

  3         restricting the application of pollution

  4         exclusion clauses; defining the term

  5         "pollutants"; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  The provisions of a property insurance

10  policy which exclude coverage based on a pollution exclusion

11  clause for bodily injury or property damage caused in whole or

12  in part by the actual, alleged, or threatened discharge,

13  dispersal, seepage, migration, release, or escape of

14  pollutants at any time, apply only to damages caused by

15  serious environmental harm.

16         (2)  As used in this section, the term "pollutants"

17  means any solid, liquid, gaseous, or thermal irritant or

18  contaminant, including smoke, vapor, soot, fumes, acid,

19  alkalis, chemicals, and waste recognized by government

20  regulators or the industry as a whole to be a toxic or

21  particularly harmful material.

22         Section 2.  This act shall take effect August 1, 2000.
