1 A bill to be entitled
2 An act relating to payment of court costs and
3 attorney's fees; providing for the board of
4 county commissioners to request the court to
5 order a defendant who has received public
6 assistance in his or her defense to perform
7 community service in satisfaction of a lien for
8 payment of attorney's fees and costs; providing
9 for the court to establish the number of hours
10 of community service required; providing an
11 effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. In any case in which the defendant has
16 received public assistance in his or her defense, has been
17 ordered to pay attorney's fees and costs, and whose real and
18 personal property is subject to a lien as provided in section
19 938.29, Florida Statutes, the board of county commissioners
20 may execute a release of the lien and request that the court
21 order the defendant to perform community service in lieu of
22 satisfaction of the lien. The court shall establish the number
23 of hours of community service necessary for the defendant to
24 perform in order to satisfy the lien.
25 Section 2. This act shall take effect upon becoming a
26 law.

2 SENATE SUMMARY
3 Authorizes the board of county commissioners to request
the court to order that a defendant who has received
4 public assistance in his or her defense perform community
service in satisfaction of the lien on the defendant's
5 property for payment of attorney's fees and costs.
Provides that the court establish the number of hours of
6 community service required to satisfy the lien.
