1 A bill to be entitled
2 An act relating to nursing homes; amending s.
3 400.141, F.S.; requiring the offering of
4 influenzae vaccinations to nursing home
5 residents and employees; requiring the offering
6 of pneumonia vaccinations to nursing home
7 residents; providing for rulemaking; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsections (14) and (15) are added to
13 section 400.141, Florida Statutes, to read:
14 400.141 Administration and management of nursing home
15 facilities.--Every licensed facility shall comply with all
16 applicable standards and rules of the agency and shall:
17 (14) Before November 30 of each year, provide for
18 immunizations against influenzae virus to all its consenting
19 residents and health care workers in accordance with the
20 recommendations of the U.S. Centers for Disease Control and
21 Prevention, subject to exemptions for medical
22 contraindications and religious beliefs. Subject to these
23 exemptions, any consenting person who becomes a resident of
24 the facility or who is employed by the facility after November
25 30 but before March 31 of the following year must be immunized
26 within 3 days after becoming a resident or an employee.
27 Immunization need not be provided to any resident or health
28 care worker who provides documentation that he or she has been
29 immunized as required by this subsection. The agency shall
30 adopt rules regarding consent forms, documentation, and
31 administrative requirements.

1 (15) Before November 30 of each year, provide for
2 immunizations against pneumonia to all its consenting
3 residents in accordance with the recommendations of the U.S.
4 Centers for Disease Control and Prevention, subject to
5 exemptions for medical contraindications and religious
6 beliefs. Subject to these exemptions, any consenting person
7 who becomes a resident of the facility must be immunized
8 within 3 days after becoming a resident. Immunization need not
9 be provided to any resident who provides documentation that he
10 or she has been immunized as required by this subsection. The
11 agency shall adopt rules regarding consent forms,
12 documentation, and administrative requirements.
13 Section 2. This act shall take effect upon becoming a
14 law.

17 SENATE SUMMARY
18 Requires nursing homes to offer influenzae vaccinations
to residents and employees of the nursing homes and to
19 offer pneumonia vaccinations to nursing home residents.
Provides for rulemaking by the Agency for Health Care
20 Administration.
