  1                      A bill to be entitled

  2         An act relating to condominiums; creating the

  3         Condominium Study Commission; providing for

  4         membership; providing legislative intent;

  5         providing for duties; providing for

  6         recommendations; providing an appropriation;

  7         providing for future repeal; providing an

  8         effective date.

  9

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Condominium Study Commission; appointment

13  of members; duties; recommendations.--

14         (1)  There is created the Condominium Study Commission.

15  The commission is to consist of 15 members.  Five members of

16  the commission, at least two of whom are members of the

17  Legislature, are to be appointed by the Speaker of the House

18  of Representatives; five members, at least two of whom are

19  members of the Legislature, are to be appointed by the

20  President of the Senate; and five members who are not members

21  of the Legislature are to be appointed by the Governor.

22  Persons appointed to the commission should represent a

23  cross-section of persons interested in condominium issues.  In

24  addition to the appointed members, the director of the

25  Division of Florida Land Sales, Condominiums, and Mobile Homes

26  shall serve as ex officio member of the commission.  For

27  administrative purposes, the commission is assigned to the

28  Division of Florida Land Sales, Condominiums, and Mobile Homes

29  of the Department of Business and Professional Regulation.

30         (2)  The commission shall conduct public hearings

31  throughout the state and take testimony regarding issues

  1  relating to condominiums and may receive recommendations for

  2  changes to the condominium law.  The commission may consider,

  3  without limitation, the continued tension between unit owners

  4  and boards of directors, the election process for the board of

  5  directors, the effectiveness of the Division of Florida Land

  6  Sales, Condominiums, and Mobile Homes in responding to

  7  complaints from unit owners, the relationship of rights and

  8  responsibilities of unit owners and the board, the method of

  9  enforcement of condominium liens, and whether the condominium

10  should be able to foreclose condominium liens against

11  individual units.  Members of the commission may receive per

12  diem and travel expenses pursuant to section 112.061, Florida

13  Statutes, while on official business of the commission.

14         (3)  The commission shall report its recommendations

15  and findings to the Governor, the President of the Senate, the

16  Speaker of the House of Representatives, and the minority

17  leaders of the Senate and the House of Representatives on or

18  before February 1, 2001, for the 2001 Regular Session of the

19  Legislature.

20         Section 2.  The sum of $100,000 is appropriated from

21  the Division of Florida Land Sales, Condominiums, and Mobile

22  Homes Trust Fund to the Department of Business and

23  Professional Regulation to carry out the provisions of this

24  act.

25         Section 3.  This act shall take effect upon becoming a

26  law and expires on June 30, 2001.

      Creates the Condominium Study Commission to conduct
  4    public hearings throughout the state, to take testimony
      regarding issues relating to condominiums, and to receive
  5    recommendations for any changes to be made in the
      condominium law.  Places the commission within the
  6    Division of Florida Land Sales, Condominiums, and Mobile
      Homes for administrative purposes.  Provides for an
  7    appropriation and for repeal on June 30, 2001.
