11 providing for amendment of the charter;
12 providing for election of the governing board;
13 providing for officers and powers; providing
14 for ad valorem taxation and non-ad valorem
15 assessments; providing planning requirements;
16 providing for annual review of user fees for
17 emergency medical services; providing for
18 policies and regulations; providing for public
19 disclosure; authorizing per diem; providing for
20 the budget; revising provisions relating to
21 taxing authority, assessment and collection of
22 taxes, financing, tax collector's
23 responsibility, expenses, treasurer's bond, and
24 financial reports; providing for liberal
25 construction; repealing all prior special acts
26 relating to the district; providing
27 severability; providing an effective date.

1 Section 1. Pursuant to section 191.015, Florida
2 Statutes, this act constitutes the codification of all special
3 acts relating to Lehigh Acres Fire Control and Rescue
4 District. It is the intent of the Legislature in enacting this
5 law to provide a single, comprehensive special act charter for
6 the district, including all current legislative authority
7 granted to the district by its several legislative enactments
8 and any additional authority granted by this act. It is
9 further the intent of this act to preserve all district
10 authority, including the authority to annually assess and levy
11 against the taxable property in the district a tax not to
12 exceed 3.5 mills on the dollar of assessed valuation, except
13 as provided in chapter 191, Florida Statutes, or chapter
14 97-340, Laws of Florida, as amended from time to time.
15 Section 2. Chapters 63-1546, 65-1825, 67-1633, 76-406,
16 79-499, 81-416, 81-417, 83-453, 85-444, 87-432, 90-387,
17 91-384, 94-456, and 96-460, Laws of Florida, and section 1 of
18 chapter 83-454, Laws of Florida, are codified, reenacted,
19 amended, and repealed as herein provided.
20 Section 3. The Lehigh Acres Fire Control and Rescue
21 District is re-created, and the charter for such district is
22 re-created and reenacted to read:

24 Section 1. Creation; Boundaries.--There is hereby
25 created and established the Lehigh Acres Fire Control and
26 Rescue District, hereinafter referred to as the district,
27 which shall include the following described lands, to wit:

26 Section 2. Status and purpose.--The Lehigh Acres Fire
27 Control and Rescue Service District, an independent special
28 district, is organized and exists for all purposes set forth
29 in this act, chapter 97-340, Laws of Florida, and chapters 189

2 this act.
3 Section 3. Creation of district; amendment of
4 charter.--The district was created by special act of the
5 Legislature in 1963. Its charter may be amended only by
6 special act of the Legislature.
7 Section 4. Governing body.--The governing authority of
8 the district shall be a board composed of five resident
9 electors of the district elected as provided in chapter
10 97-340, Laws of Florida, and chapter 191, Florida Statutes, as
11 they may be amended from time to time.
12 Section 5. Officers; powers.--
13 (1) Within 60 days after the election and
14 qualification of members of the board, such members shall meet
15 and elect from the membership a president, a secretary, and a
16 treasurer; provided, however, the same member may be both
17 secretary and treasurer. The district shall have, and the
18 board may exercise, all those general and special powers and
19 duties prescribed in chapter 191, Florida Statutes, and
20 chapter 97-340, Laws of Florida, as they may be amended from
21 time to time.
22 (2) The district shall have, and the board may
23 exercise, all powers, functions, and duties set forth in
24 chapters 189 and 191, Florida Statutes, and chapter 97-340,
25 Laws of Florida, as they may be amended from time to time,
26 regarding ad valorem taxation, bond issuance, other
27 revenue-raising capabilities, budget preparation and approval,
28 liens and foreclosure of liens, use of tax deeds and tax
29 certificates as appropriate for non-ad valorem assessments,
30 and contractual agreements. The district may be financed by
31 any method established in this act, chapter 189 or chapter

2 other applicable general or special law, as they may be
3 amended from time to time.
4 (3) The methods for assessing and collecting non-ad
5 valorem assessments, fees, or service charges shall be as set
6 forth in chapters 170, 197, 189, and 191, Florida Statutes,
7 and chapter 97-340, Laws of Florida, as they may be amended
8 from time to time.
9 (4) The district's planning requirements shall be as
10 set forth in this act, chapters 189 and 191, Florida Statutes,
11 and chapter 97-340, Laws of Florida, as they may be amended
12 from time to time.
13 (5) The district's geographic boundary limitations
14 shall be as set forth in this act.
15 (6) The district is authorized to charge user fees for
16 emergency medical services. The fee schedule shall be
17 determined by the board. These fees shall be reviewed on an
18 annual basis, and any increase or decrease from the existing
19 fee schedule shall become effective October 1 of each year.
20 Section 6. Policies and regulations.--The board is
21 hereby authorized and empowered to adopt policies and
22 regulations for fire control, prevention of fires, and
23 emergency rescue work within the district. Such policies and
24 regulations, after being made by the board and copies thereof
25 signed by the president and secretary, and posted in at least
26 three public places within said district, one of which must be
27 the fire station or such similar place wherein the
28 firefighting equipment is normally kept, within 10 days after
29 said policies and regulations are adopted by the board, shall
30 have force and effect as law.

1 Section 7. Public disclosure.--Requirements for
2 financial disclosure, meeting notices, reporting, public
3 records maintenance, and per diem expenses for officers and
4 employees shall be as set forth in chapters 112, 119, 189,
5 191, and 286, Florida Statutes, and chapter 97-340, Laws of
6 Florida, as they may be amended from time to time.
7 Section 8. Budget.--For the purposes of carrying into
8 effect this act, the board shall annually prepare, consider,
9 and adopt a district budget pursuant to the applicable
10 requirements of chapter 200, Florida Statutes, as it may be
11 amended from time to time.
12 Section 9. Taxing authority.--The board shall fix and
13 cause to be levied on all property of said district, real and
14 personal, a millage sufficient to meet the requirements of the
15 adopted budget, provided, however, 3.5 mills is the maximum
16 that can be levied in any one year, except as provided in
17 chapter 191, Florida Statutes, or chapter 97-340, Laws of
18 Florida, as amended from time to time.
19 Section 10. Assessment and collection of taxes;
20 financing.--Taxes herein provided for shall be assessed and
21 collected in the same manner and form as provided for the
22 assessment and collection of county taxes.
23 Section 11. Tax collector's responsibility.--When such
24 taxes as herein provided for shall have been collected by the
25 tax collector of Lee County, he or she shall, on or before the
26 10th day of each month, report to the secretary of the board
27 the collections made for the preceding month and remit the
28 same from such treasurer. Thereupon the tax collector shall be
29 relieved from all other and further liability as to the amount
30 so paid the treasurer of the board.

1 Section 12. Expenses.--All warrants for the payment of
2 labor, equipment, and other expenses of the board, and in
3 carrying into effect this act and the purpose thereof, shall
4 be payable by the treasurer of the board on accounts and
5 vouchers approved by the board.
6 Section 13. Treasurer's bond.--The treasurer of the
7 board, when entering upon his or her duties, shall give a good
8 and sufficient bond to the Governor of Florida in the sum of
9 $5,000 for the faithful performance of his or her duties as
10 such treasurer.
11 Section 14. Financial reports.--The treasurer shall,
12 on or before the 10th day of April and 10th day of October
13 each year, make his or her semiannual report of receipts and
14 expenditures of the funds of said district to the board. Such
15 report shall be in writing, setting forth the amount of money
16 received, from whom received, and itemized amounts of
17 expenditures and to whom paid and for what such payment is
18 made. At the time of making such report to the board, the
19 treasurer shall also file a copy of such report with the Board
20 of County Commissioners of Lee County.
21 Section 15. Construction.--This act shall be construed
22 as a remedial act and shall be liberally construed to promote
23 the purpose for which it is intended.

25 Section 4. Chapters 63-1546, 65-1825, 67-1633, 76-406,
26 79-499, 81-416, 81-417, 83-453, 85-444, 87-432, 90-387,
27 91-384, 94-456, and 96-460, Laws of Florida, and section 1 of
28 chapter 83-454, Laws of Florida, are repealed.
29 Section 5. In the event any section or provision of
30 this act is determined to be invalid or unenforceable, such

1 determination shall not affect the validity or enforceability
2 of each other section and provision of this act.
3 Section 6. This act shall take effect upon becoming a
4 law.
