  2         An act relating to public records; amending s.

  3         787.03, F.S.; providing an exemption from

  4         public records requirements for information

  5         provided to sheriffs and state attorneys by

  6         persons who take minor children when fleeing

  7         from domestic violence; providing for future

  8         review and repeal; providing findings of public

  9         necessity; providing a contingent effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Paragraph (c) is added to subsection (6) of

15  section 787.03, Florida Statutes, as amended by SB     , to

16  read:

17         787.03  Interference with custody.--

18         (6)

19         (c)  Information provided to a sheriff or state

20  attorney under paragraph (b) is confidential and exempt from

21  s. 119.07(1) and s. 24(a), Art. I of the State Constitution.

22  This paragraph is subject to the Open Government Sunset Review

23  Act of 1995 in accordance with s. 119.15 and is repealed on

24  October 2, 2005, unless reviewed and saved from repeal through

25  reenactment by the Legislature before that date.

26         Section 2.  The Legislature finds that exempting

27  information provided to sheriffs and state attorneys under

28  section 787.03(6)(b), Florida Statutes, by persons fleeing

29  from domestic violence or the threat of it is a public

30  necessity. The information is of a sensitive, personal nature

  1  and concerns individuals who are under threat of physical and

  2  psychological harm if their whereabouts is revealed.

  3         Section 3.  This act shall take effect July 1, 2000,

  4  but it shall not take effect if Senate Bill     , or similar

  5  legislation requiring certain identifying information to be

  6  filed by persons who take minor children when fleeing

  7  situations of domestic violence, does not become a law.
