8 students to be transported to include students
9 living 1 mile or more from school; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Paragraph (a) of subsection (2) of section
15 234.021, Florida Statutes, is amended to read:
16 234.021 Hazardous walking conditions.--
17 (2) IDENTIFICATION.--
18 (a) When a request for review is made to the district
19 superintendent of schools or the district superintendent's
20 designee concerning a condition perceived to be hazardous to
21 students in that district who live within the 1-mile 2-mile
22 limit and who walk to school, such condition shall be
23 inspected by a representative of the school district and a
24 representative of the local governmental entity where the
25 perceived hazardous condition exists. Such representatives
26 shall determine whether or not the condition is hazardous to
27 such students and shall report to the Department of Education
28 with respect thereto. Upon a determination that a condition
29 is hazardous to such students, the district school board shall
30 request a determination from the state or local governmental
31 entity having jurisdiction regarding whether the hazard will

1 be corrected and, if so, regarding a projected completion
2 date. State funds shall be allocated for the transportation
3 of students subjected to such hazards, provided that such
4 funding shall cease upon correction of the hazard or upon the
5 projected completion date, whichever occurs first.
6 Section 2. Paragraph (a) of subsection (1) of section
7 236.083, Florida Statutes, is amended to read:
8 236.083 Funds for student transportation.--The annual
9 allocation to each district for transportation to public
10 school programs of students in membership in kindergarten
11 through grade 12, in migrant and exceptional student programs
12 below kindergarten, and in any other state-funded
13 prekindergarten program shall be determined as follows:
14 (1) Subject to the rules of the commissioner, each
15 district shall determine the membership of students who are
16 transported:
17 (a) By reason of living 1 mile 2 miles or more from
18 school;
19 Section 3. This act shall take effect July 1, 2000.
