13         Amendment (with title amendment) 

14         On page 4, between lines 16 and 17,

16  insert:

17         Section 2.  Subsection (13) is added to section

18  367.022, Florida Statutes, to read:

19         367.022  Exemptions.--The following are not subject to

20  regulation by the commission as a utility nor are they subject

21  to the provisions of this chapter, except as expressly

22  provided:

23         (13)  Wastewater facilities serving 350 or fewer

24  persons and owned and controlled by a nonprofit corporation,

25  association, or cooperative if such persons receive water

26  service from governmental authorities pursuant to subsection

27  (2). Wastewater service shall be available on a

28  nondiscriminatory basis to all persons within the territory to

29  be served and at least 75 percent of persons receiving service

30  shall be members of the nonprofit corporation, association, or

31  cooperative. Wastewater service shall be provided without
