  1                      A bill to be entitled

  2         An act relating to public utility rate case

  3         expense recovery; amending s. 367.0816, F.S.;

  4         requiring a public utility to reduce its rates

  5         after a period to recover rate case expenses;

  6         providing for retroactive effect; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 367.0816, Florida Statutes, is

12  amended to read:

13         367.0816  Recovery of rate case expenses.--The amount

14  of rate case expense determined by the commission pursuant to

15  the provisions of this chapter to be recovered through a

16  public utility's utilities rate shall be apportioned for

17  recovery over a period of 4 years. At the conclusion of the

18  recovery period, the rate of the public utility shall be

19  reduced immediately by the amount of rate case expense

20  previously included in rates.

21         Section 2.  This act shall take effect upon becoming a

22  law and shall operate retroactively to June 11, 1999.
