18 Section 22. Section 325.2135, Florida Statutes, is
19 amended to read:
20 325.2135 Motor vehicle emissions inspection program;
21 contracts; fees.--The department may extend the current
22 emissions inspection program contracts for a period of time
23 sufficient to implement new contracts resulting from
24 competitive proposals, and shall enter into and implement one
25 or more contracts by June 30, 2000, for a biennial inspection
26 program for vehicles, except the current model year and the
27 two prior model years, using the basic test for hydrocarbon
28 emissions and carbon monoxide emissions. The requirements for
29 the program included in the contract proposals must be based
30 on the requirements under this chapter unless those
31 requirements conflict with this section. No contract entered

1 into under this subsection may be for longer than 7 years. Any
2 contract authorized under this section must contain a
3 provision that, after 4 years, the department reserves the
4 right to cancel the contract upon 6 months' notice to the
5 contractor upon a determination by the Secretary of the
6 Department of Environmental Protection that a motor vehicle
7 emissions inspection program is no longer needed in the
8 program area. In the event of such a contract cancellation,
9 the state shall be relieved of any financial obligations for
10 the remainder of the contract. Notwithstanding the provisions
11 of s. 325.214, the fee for motor vehicle inspection proposed
12 by the Department of Highway Safety and Motor Vehicles may not
13 exceed $19 per inspection.
