11  Senator Holzendorf moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 52, lines 7-17, delete those lines

15

16  and insert:

17         112.324  Procedures on complaints of violations.--

18         (10)(a)  Notwithstanding the provisions of subsections

19  (1)-(7), the commission may, at its discretion, dismiss any

20  complaint or proceeding at any stage of disposition should it

21  determine that the public interest would not be served by

22  proceeding further, in which case the commission shall issue a

23  public report stating with particularity its reasons for the

24  dismissal.  The investigation of facts and parties materially

25  related to a complaint, as provided in s. 112.322(1) and

26  pursuant to the definitions contained in s. 112.312(11) and

27  (18), and the amendment of s. 112.3143 shall apply only to

28  alleged violations occurring after May 24, 1991.

29         (b)  If the commission undertakes to investigate a

30  reporting individual for failing to properly report under s.

31  8, Art. II of the State Constitution, s. 112.3144, or s.

 1  112.3145 and the investigation reveals and the commission

 2  finds that the error was technical or minor in nature, the

 3  commission may notify the respondent of the error and may

 4  request that an amended report correcting the error be filed

 5  with the commission and the filing officer within 10 days

 6  after the respondent receives the notice. The commission shall

 7  dismiss the matter without further proceedings if:

 8         1.  The reporting individual timely files an amended

 9  report correcting the error;

10         2.  The commission has not determined that the

11  reporting individual has previously violated s. 8, Art. II of

12  the State Constitution, s. 112.3144, or s. 112.3145; and

13         3.  The reporting individual has not previously filed

14  or been asked to file an amended report under this paragraph.
