12  for amendment (354574):

14         Senate Amendment (with title amendment) 

15         On page 1, between lines 24 and 25,

16

17  insert:

18         Section 3.  Notwithstanding any provision of section

19  465.025, Florida Statutes, for the initial prescription or any

20  refill thereunder of a therapeutically equivalent or

21  "A-B"-rated drug that is currently on the negative formulary

22  created under that statute, a pharmacist must dispense the

23  drug unless prior approval to substitute is obtained from the

24  prescriber of the medication. Any refill thereunder of the

25  initial prescription for such a drug must be refilled using

26  only the same drug product by the same manufacturer which the

27  pharmacist last dispensed under the prescription.
