14 On page 1, lines 14 through 28, delete those lines,

16 and insert:
17 Section 1. The Board of Medicine, the Board of
18 Osteopathic Medicine, and the Board of Pharmacy must jointly
19 submit a report to the Legislature by January 1, 2002, which
20 recommends whether the formulary for generic and brand-name
21 drugs required by section 465.025(6), Florida Statutes, should
22 be retained. The boards shall use their scientific knowledge
23 and experience in compiling the report and shall consider all
24 data in determining those measures that are needed to protect
25 the health and safety of patients. The board may consider the
26 bioequivalence of the drugs listed on the formulary and shall
27 consider other factors involved with drug-product selection,
28 the use of products by patients, the practice of pharmacy,
29 publications of the Federal Food and Drug Administration, and
30 adverse experience reports of the Federal Food and Drug
31 Administration that they determine are relevant to the issues

1 under consideration. The boards may choose to confirm the
2 present administrative procedure to add or delete a drug from
3 the formulary without reviewing and recommending changes to
4 the existing statutes.
5 Section 2. This act shall take effect upon becoming a
6 law.
