1 A bill to be entitled
2 An act relating to pharmacy; requiring the
3 Board of Medicine and the Board of Pharmacy to
4 provide recommendations and submit a report to
5 the Legislature concerning the formulary for
6 generic and brand-name drugs; repealing s.
7 465.025(6), F.S., which requires the
8 establishment of a formulary of generic and
9 brand-name drug products which are
10 inequivalent; providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. The Board of Medicine and the Board of
15 Pharmacy must jointly submit a report to the Legislature by
16 January 1, 2001, which recommends whether the formulary for
17 generic and brand-name drugs required by section 465.025(6),
18 Florida Statutes, should be retained. If the report recommends
19 retention of the formulary established under section
20 465.025(6), Florida Statutes, the report must specify how
21 further restrictions on generic drug substitution will be
22 based solely on scientific evidence of drug equivalency and
23 what standards and evidence will be used in making such
24 determinations and must estimate the costs of making drug
25 equivalency determinations in Florida.
26 Section 2. Effective July 1, 2001, subsection (6) of
27 section 465.025, Florida Statutes, is repealed.
28 Section 3. This act shall take effect July 1, 2000.
