13         Senate Amendment (with title amendment) 

14         On page 5, before line 1,

15

16  insert:

17         Section 4.  Paragraph (d) of subsection (7) of section

18  212.08, Florida Statutes, is amended to read:

19         212.08  Sales, rental, use, consumption, distribution,

20  and storage tax; specified exemptions.--The sale at retail,

21  the rental, the use, the consumption, the distribution, and

22  the storage to be used or consumed in this state of the

23  following are hereby specifically exempt from the tax imposed

24  by this chapter.

25         (7)  MISCELLANEOUS EXEMPTIONS.--

26         (d)  Feeds.--Feeds for poultry, ostriches, and

27  livestock, including racehorses, racing greyhounds, and dairy

28  cows, are exempt.

30  Exemptions provided to any entity by this subsection shall not

31  inure to any transaction otherwise taxable under this chapter

 1  when payment is made by a representative or employee of such

 2  entity by any means, including, but not limited to, cash,

 3  check, or credit card even when that representative or

 4  employee is subsequently reimbursed by such entity.

10  And the title is amended as follows:

11         On page 1, lines 2-22, delete those lines

12

13  and insert:

14         An act relating to taxation; amending s.

15         211.31, F.S.; increasing the amount of funds

16         credited to the Minerals Trust Fund from

17         severance taxes that remains in the trust fund

18         at the end of the fiscal year; amending s.

19         211.3103, F.S.; revising the distribution of

20         the revenues from the tax on the severance of

21         phosphate rock under specified circumstances;

22         repealing s. 211.3103(9), F.S., which requires

23         that when a county accepts a donation of real

24         or other property from a producer the amount of

25         the proceeds of said tax returned to that

26         county be reduced by the value of the donation;

27         amending s. 378.036, F.S.; revising

28         requirements relating to a list identifying

29         certain nonmandatory lands developed by the

30         Department of Environmental Protection and the

31         Fish and Wildlife Conservation Commission and
