2 An act relating to release of employee
3 information by employers; providing specified
4 requirements of employers with respect to a
5 background investigation of an applicant for
6 employment or appointment as a full-time,
7 part-time, or auxiliary law enforcement
8 officer, correctional officer, or correctional
9 probation officer; providing requirements with
10 respect to an authorization to release
11 information; providing an effective date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. When a law enforcement, correctional, or
16 correctional probation officer is conducting a background
17 investigation of an applicant for temporary or permanent
18 employment or appointment as a full-time, part-time, or
19 auxiliary law enforcement, correctional, or correctional
20 probation officer with an employing agency as defined in
21 section 943.10(4), Florida Statutes, the applicant's current
22 or former employer, or the employer's agent, shall provide to
23 the officer conducting the background investigation the
24 complete employment record of the applicant and, to the extent
25 known, any other verifiable information that would lead
26 someone to believe that the applicant fails to meet the
27 minimum qualifications set forth in section 943.13, Florida
28 Statutes. The investigating officer must present to the
29 current or former employer credentials demonstrating
30 employment credentials demonstrating employment with the
31 employing agency. Upon the presentation of an authorization

1 form for release of information, the employer shall provide to
2 the investigating officer the requested information, which may
3 include a copy of the complete employment record or portion
4 thereof. The form must be designed and approved by the
5 Criminal Justice Standards and Training Commission and must:
6 (1) Be either the original authorization or a copy or
7 facsimile of the original authorization.
8 (2) Have been executed by the applicant no more than 1
9 year before the request.
10 (3) Contain a statement that the authorization has
11 been specifically furnished to the presenting law enforcement
12 agency.
13 (4) Bear the notarized signature of the applicant.
14 Section 2. This act shall take effect upon becoming a
15 law.

18 LEGISLATIVE SUMMARY
19 Provides specified requirements of employers with respect
to a background investigation of an applicant for
20 employment or appointment as a full-time, part-time, or
auxiliary law enforcement officer, correctional officer,
