11  Senator Kirkpatrick moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 4, between lines 2 and 3,

15

16  insert:

17         Section 2.  Subsection (4) of section 372.16, Florida

18  Statutes, is amended to read:

19         372.16  Private game preserves and farms; penalty.--

20         (4)  Any person violating the provisions of this

21  section shall for the first offense be guilty of a misdemeanor

22  of the second degree, punishable as provided in s. 775.082 or

23  s. 775.083, and for a second or subsequent offense shall be

24  guilty of a misdemeanor of the first degree, punishable as

25  provided in s. 775.082 or s. 775.083.  Any person convicted of

26  violating the provisions of this section shall forfeit, to the

27  Fish and Wildlife Conservation Commission, any license or

28  permit issued under the provisions hereof; and no further

29  license or permit shall be issued to such person for a period

30  of 1 year following such conviction. Before any private game

31  preserve or farm is established, the owner or operator shall

 1  secure a license from the Fish and Wildlife Conservation

 2  Commission, the fee for which shall be $25 $5 per year.
