17 Section 9739. Effective July 1, 2001, subsection (3)
18 of section 489.109, Florida Statutes, is amended to read:
19 489.109 Fees.--
20 (3) In addition to the fees provided in subsection (1)
21 for application and renewal for certification and
22 registration, all certificateholders and registrants must pay
23 a fee of $4 to the department at the time of application or
24 renewal. The funds must be transferred at the end of each
25 licensing period to the Department of Community Affairs
26 Education to fund projects relating to the building
27 construction industry or continuing education programs offered
28 to persons engaged in the building construction industry in
29 Florida, to be selected by the Florida Building Commission.
30 The board shall, at the time the funds are transferred, advise
31 the Department of Community Affairs Education on the most

1 needed areas of research or continuing education based on
2 significant changes in the industry's practices or on changes
3 in the state building code or on the most common types of
4 consumer complaints or on problems costing the state or local
5 governmental entities substantial waste. The board's advice is
6 not binding on the Department of Community Affairs Education.
7 The Department of Education must allocate 50 percent of the
8 funds to a graduate program in building construction in a
9 Florida university and 50 percent of the funds to all
10 accredited private and state universities and community
11 colleges within the state offering approved courses in
12 building construction, with each university or college
13 receiving a pro rata share of such funds based upon the number
14 of full-time building construction students enrolled at the
15 institution. The Department of Community Affairs Education
16 shall ensure the distribution of research reports and the
17 availability of continuing education programs to all segments
18 of the building construction industry to which they relate.
19 The Department of Community Affairs Education shall report to
20 the board in October of each year, summarizing the allocation
21 of the funds by institution and summarizing the new projects
22 funded and the status of previously funded projects.
