  1                      A bill to be entitled

  2         An act relating to the Florida Statutes;

  3         repealing various statutory provisions that

  4         have become obsolete, have had their effect,

  5         have served their purpose, or have been

  6         impliedly repealed or superseded; repealing ss.

  7         13.90-13.996, F.S., relating to the Florida

  8         Legislative Law Revision Council; repealing s.

  9         16.58(2)(g), F.S., relating to a pilot project

10         of the Florida Legal Resource Center to provide

11         court reporting services to state agencies;

12         repealing ss. 25.074 and 25.081, F.S., relating

13         to the Supreme Court's assignment of circuit

14         and county court judges to geographical areas

15         and the seal of the Supreme Court; repealing s.

16         27.0055, F.S., relating to official court

17         reporters; amending s. 34.01, F.S.; eliminating

18         obsolete provisions relating to actions at law

19         subject to jurisdiction of the county courts;

20         repealing s. 35.09, F.S., relating to seals of

21         the district courts of appeal; repealing s.

22         46.015(4), F.S., relating to applicability of

23         provisions relating to release of parties to

24         written releases or covenants not to sue

25         executed after a certain date; repealing s.

26         46.051(6)(b), F.S., relating to applicability

27         of provisions relating to joinder of products

28         liability insurers to causes of action accruing

29         on or after a certain date; repealing s.

30         57.111(6)(b), F.S., relating to applicability

31         of the Florida Equal Access to Justice Act;

  1         repealing s. 60.02, F.S., relating to

  2         jurisdiction of chancery courts to enjoin

  3         against destruction of timber and removal of

  4         logs; repealing s. 68.091(2), F.S., relating to

  5         severability of the provisions of the Florida

  6         False Claims Act; repealing s. 92.55(1), F.S.,

  7         relating to findings and a request of the

  8         Supreme Court to amend applicable rules of

  9         procedure to conform with statutory provisions

10         to protect the interests of children or persons

11         with mental retardation as witnesses in

12         criminal, civil, or juvenile proceedings;

13         repealing s. 112.3217(4), F.S., relating to

14         applicability to existing contracts of

15         provisions prohibiting contingency fees;

16         providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  Sections 13.90, 13.91, 13.92, 13.93, 13.94,

21  13.95, 13.96, 13.97, 13.98, 13.99, 13.992, 13.993, 13.994,

22  13.995, and 13.996, Florida Statutes, are repealed

23         Section 2.  Paragraph (g) of subsection (2) of section

24  16.58, Florida Statutes, is repealed.

25         Section 3.  Sections 25.074 and 25.081, Florida

26  Statutes, are repealed.

27         Section 4.  Section 27.0055, Florida Statutes, is

28  repealed.

29         Section 5.  Paragraph (c) of subsection (1) of section

30  34.01, Florida Statutes, is amended to read:

31         34.01  Jurisdiction of county court.--

  1         (1)  County courts shall have original jurisdiction:

  2         (c)  As to causes of action accruing:

  3         1.  Before July 1, 1980, of all actions at law in which

  4  the matter in controversy does not exceed the sum of $2,500,

  5  exclusive of interest, costs, and attorney's fees, except

  6  those within the exclusive jurisdiction of the circuit courts.

  7         2.  On or after July 1, 1980, of all actions at law in

  8  which the matter in controversy does not exceed the sum of

  9  $5,000, exclusive of interest, costs, and attorney's fees,

10  except those within the exclusive jurisdiction of the circuit

11  courts.

12         3.  On or after July 1, 1990, of actions at law in

13  which the matter in controversy does not exceed the sum of

14  $10,000, exclusive of interest, costs, and attorney's fees,

15  except those within the exclusive jurisdiction of the circuit

16  courts.

17         4.  On or after July 1, 1992, Of all actions at law in

18  which the matter in controversy does not exceed the sum of

19  $15,000, exclusive of interest, costs, and attorney's fees,

20  except those within the exclusive jurisdiction of the circuit

21  courts. The party instituting any civil action, suit, or

22  proceeding pursuant to this paragraph schedule where the

23  amount in controversy is in excess of $5,000 shall pay to the

24  clerk of the county court the filing fees and service charges

25  in the same amounts and in the same manner as provided in s.

26  28.241.

27         Section 6.  Section 35.09, Florida Statutes, is

28  repealed.

29         Section 7.  Subsection (4) of section 46.015 and

30  paragraph (b) of subsection (6) of section 46.051, Florida

31  Statutes, are repealed.

  1         Section 8.  Paragraph (b) of subsection (6) of section

  2  57.111, Florida Statutes, is repealed.

  3         Section 9.  Section 60.02, Florida Statutes, is

  4  repealed.

  5         Section 10.  Subsection (2) of section 68.091, Florida

  6  Statutes, is repealed.

  7         Section 11.  Subsection (1) of section 92.55, Florida

  8  Statutes, is repealed.

  9         Section 12.  Subsection (4) of section 112.3217,

10  Florida Statutes, is repealed.

11         Section 13.  This act shall take effect upon becoming a

12  law.
