2 An act relating to toll facilities; amending s.
3 338.155, F.S.; exempting certain vehicles on
4 official business from the payment of tolls on
5 toll facilities; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Subsection (1) of section 338.155, Florida
10 Statutes, is amended to read:
11 338.155 Payment of toll on toll facilities required;
12 exemptions.--
13 (1) No persons are permitted to use any toll facility
14 without payment of tolls, except employees of the agency
15 operating the toll project when using the toll facility on
16 official state business, state military personnel while on
17 official military business, handicapped persons as provided in
18 this section, persons exempt from toll payment by the
19 authorizing resolution for bonds issued to finance the
20 facility, and persons exempt on a temporary basis where use of
21 such toll facility is required as a detour route. Any law
22 enforcement officer Florida highway patrol officer, sheriff,
23 deputy sheriff, or municipal police officer operating a marked
24 official vehicle is exempt from toll payment when on official
25 law enforcement business. Any person operating a fire vehicle
26 when on official business or a rescue vehicle when on official
27 business is exempt from toll payment. The secretary, or the
28 secretary's designee, may suspend the payment of tolls on a
29 toll facility when necessary to assist in emergency
30 evacuation. The failure to pay a prescribed toll constitutes a

1 noncriminal traffic infraction, punishable as a moving
2 violation pursuant to s. 318.18.
3 Section 2. This act shall take effect July 1, 2000.
