  1                      A bill to be entitled

  2         An act relating to osteoporosis; amending ss.

  3         627.6409, 627.6691, 641.31, F.S.; expanding the

  4         required health insurance coverage for

  5         osteoporosis-related matters; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Section 627.6409, Florida Statutes, is

11  amended to read:

12         627.6409  Coverage for osteoporosis screening,

13  diagnosis, treatment, and management.--Any health insurance

14  policy that covers a resident of this state and that is

15  issued, amended, delivered, or renewed in this state after

16  October 1, 1996, must provide coverage for the medically

17  necessary testing, diagnosis, and treatment of osteoporosis

18  for high-risk individuals, including, but not limited to,

19  estrogen-deficient individuals who are at clinical risk for

20  osteoporosis, individuals who have vertebral abnormalities,

21  individuals who are receiving long-term glucocorticoid

22  (steroid) therapy, individuals who have primary

23  hyperparathyroidism, and individuals who have a family history

24  of osteoporosis. This section does not apply to

25  specified-accident, specified-disease, hospital-indemnity,

26  Medicare supplement, or long-term-care health insurance

27  policies or to the state employee health insurance program.

28         Section 2.  Section 627.6691, Florida Statutes, is

29  amended to read:

30         627.6691  Coverage for osteoporosis screening,

31  diagnosis, treatment, and management.--Any group, blanket, or

  1  franchise health insurance policy that covers a resident of

  2  this state and that is issued, amended, delivered, or renewed

  3  in this state after October 1, 1996, must provide coverage for

  4  the medically necessary testing, diagnosis, and treatment of

  5  osteoporosis for high-risk individuals, including, but not

  6  limited to, estrogen-deficient individuals who are at clinical

  7  risk for osteoporosis, individuals who have vertebral

  8  abnormalities, individuals who are receiving long-term

  9  glucocorticoid (steroid) therapy, individuals who have primary

10  hyperparathyroidism, and individuals who have a family history

11  of osteoporosis. This section does not apply to

15         Section 3.  Subsection (27) of section 641.31, Florida

16  Statutes, is amended to read:

17         641.31  Health maintenance contracts.--

18         (27)  Any health maintenance contract that covers a

19  resident of this state and that is issued, amended, delivered,

20  or renewed in this state after October 1, 1996, must provide

21  coverage for the medically necessary testing, diagnosis, and

22  treatment of osteoporosis for high-risk individuals,

23  including, but not limited to, estrogen-deficient individuals

24  who are at clinical risk for osteoporosis, individuals who

25  have vertebral abnormalities, individuals who are receiving

26  long-term glucocorticoid (steroid) therapy, individuals who

27  have primary hyperparathyroidism, and individuals who have a

28  family history of osteoporosis. This subsection does shall not

29  apply to the state employee health insurance program.

30         Section 4.  This act shall take effect July 1, 2000.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                              SB 412

  3

  4  The committee substitute requires coverage for medically
    necessary testing of osteoporosis for high-risk individuals.
  5  It deletes the requirement in the original bill that coverage
    include bone-mass density testing for osteoporosis in
  6  high-risk individuals when deemed medically necessary.
