15 On page 3, between lines 5 and 6, of the bill

17 insert:
18 Section 3. Section 465.014, Florida Statutes, is
19 amended to read:
20 465.014 Pharmacy technician.--No person other than a
21 licensed pharmacist or pharmacy intern may engage in the
22 practice of the profession of pharmacy, except that a licensed
23 pharmacist may delegate to nonlicensed pharmacy technicians
24 those duties, tasks, and functions which do not fall within
25 the purview of s. 465.003(13). All such delegated acts shall
26 be performed under the direct supervision of a licensed
27 pharmacist who shall be responsible for all such acts
28 performed by persons under his or her supervision. A pharmacy
29 technician, under the supervision of a pharmacist, may
30 initiate or receive communications with a practitioner or his
31 or her agent, on behalf of a patient, regarding refill

1 authorization requests. No licensed pharmacist shall
2 supervise more than one pharmacy technician unless otherwise
3 permitted by the guidelines adopted by the board. Pharmacy
4 technicians must complete a pharmacy technician certification
5 course as approved by the board. After initial certification,
6 certified pharmacy technicians shall participate in not less
7 than eight hours of continuing pharmacy technician education
8 every two years. The board shall establish guidelines to be
9 followed by licensees or permittees in determining the
10 circumstances under which a licensed pharmacist may supervise
11 more than one but not more than three pharmacy technicians.
12 After January 1, 2001, no pharmacy shall employ a pharmacy
13 technician who has not satisfactorily completed a pharmacy
14 technician certification course and received certification and
15 participated in continuing education courses as provided
16 herein.
