19 465.0075 Temporary certificate for practice in areas
20 of critical need.--
21 (1) Any pharmacist who is actively licensed to
22 practice in any other state may be issued a temporary
23 certificate to practice the profession of pharmacy in counties
24 where there is a critical need for pharmacists, provided such
25 pharmacist:
26 (a) Has actively practiced the profession of pharmacy
27 for at least 2 years immediately preceding application under
28 this section.
29 (b) Possesses a currently valid license.
30 (c) Has passed the jurisprudence portion of the
31 Florida license examination.

1 (d) Has passed the NAPLEX examination within 15 years
2 of the date of application under this section.
3 (e) Pays a biannual application fee of $100.

5 A certificate may be issued to a pharmacist who will be
6 employed by a county health department, correctional facility,
7 community health center funded by s. 329, s. 330, or s. 340 of
8 the United States Public Health Services Act, or any pharmacy
9 that is permitted under this chapter.
10 (2) Beginning October 1, 2000, and at least annually
11 thereafter, the board shall, at a meeting scheduled and
12 noticed for such purpose, determine each county of critical
13 need utilizing the criteria set forth in 42 C.F.R. 5, Appendix
14 F, and the pharmacist so certified may practice in any such
15 county for a time to be determined by the board, but not
16 longer than 24 months without such pharmacist being
17 recertified by the board. Such areas shall include, but not be
18 limited to, health professional shortage areas designated by
19 the United States Department of Health and Human Services.
20 Substantially affected persons wishing to challenge such
21 designations must file a petition for formal administrative
22 hearing within 21 days of the board's designation.
23 (3) A recipient of a temporary certificate for
24 practice in counties of critical need may use the license to
25 work for any pharmacy located in any county of critical need.
26 (4) The recipient of a temporary certificate for
27 practice in counties of critical need shall, within 30 days
28 after accepting employment, notify the board of all approved
29 institutions in which the licensee practices.
30 (5) The recipient of a temporary certificate shall
31 comply with the continuing education requirements of this

1 chapter which accrue during the period of time such recipient
2 is licensed under this section.
3 (6) The board may administer an abbreviated oral
4 examination to determine the pharmacist's competency, but no
5 written regular examination is required.
6 (7) Any certificate issued under this section shall be
7 valid only so long as the licensee practices in a county of
8 critical need and the county remains a county of critical
9 need. The Board of Pharmacy must review the level of pharmacy
10 services within each county of critical need not less than
11 annually to ascertain that the minimum requirements of this
12 chapter and the rules and regulations promulgated thereunder
13 are being complied with. If it is determined that such minimum
14 requirements are not being met, the board shall forthwith
15 revoke such certificate.
16 (8) The board shall not issue a temporary certificate
17 for practice in an area of critical need to any pharmacist who
18 is under investigation in another state for an act which would
19 constitute a violation of this chapter or whose license to
20 practice pharmacy has been suspended or revoked in another
21 state.
