11  The Committee on Criminal Justice recommended the following

12  amendment:

14         Senate Amendment 

15         On page 1, line 24, after the period

16

17  insert:  However, immunity from civil or criminal liability

18  under this section, as provided in this paragraph, shall only

19  apply to a law enforcement officer acting in the officer's

20  official capacity during the course of an active criminal

21  investigation approved or authorized by the officer's agency,

22  or to an informer or third party acting under the direction or

23  control of such officer as part of an authorized, active

24  criminal investigation.
