19 (3) HOME INSPECTION SERVICES; STANDARDS OF PRACTICE.--
20 (a) The Department of Agriculture and Consumer
21 Services shall adopt, by incorporation, one or more nationally
22 recognized minimum standards of practice for home inspection
23 services.
24 (b) The department shall adopt, by incorporation, one
25 or more nationally recognized minimum standards of practice
26 for home inspector to claim to be a "certified home
27 inspector." Any such standard shall require that a home
28 inspector have experience requirements and have successfully
29 passed an examination regarding home inspections.
30 (c) In adopting the rules required by this subsection,
31 the department is not to promulgate specific rules setting

1 forth standards, but to simply adopt by incorporation
2 standards developed by nationally recognized organizations.
3 In adopting the rules required by this subsection, the
4 department shall consult with representatives of the Florida
5 home inspection industry, the Florida Building Code
6 Administrators and INspectors Board, the Construction Industry
7 LIcensing Board, and the Electrical Contractors' Licensing
8 Board.
9 (d) The purpose and intent to this legislation is not
10 to create or impose a bureau or other agency of state
11 government to regulate the affairs of home inspectors.
12 Accordingly, the Department of Agriculture and Consumer
13 Services shall not license a home inspector, collect fees from
14 a home inspector for licensure, or file an administrative
15 complaint against a home inspector for violation of this
16 section or for violation of administrative code and rules
17 promulgated pursuant to this section.
