17 Section 1. Subsection (13) is added to section 318.21,
18 Florida Statutes, to read:
19 318.21 Disposition of civil penalties by county
20 courts.--All civil penalties received by a county court
21 pursuant to the provisions of this chapter shall be
22 distributed and paid monthly as follows:
23 (13)(a) A municipality located in a county with a
24 population of over 1 million people may, by a super majority
25 (a majority plus one) vote of the governing board of the
26 municipality, impose a surcharge of up to $5 on the amount of
27 civil penalties required under s. 318.18 for traffic
28 infractions for the sole purpose of funding residential
29 traffic calming programs. The surcharge may not be levied on
30 traffic infractions occurring on any state road as defined by
31 s. 316.003(50). The surcharge must be authorized by ordinance

1 requiring public hearings.
2 (b) The proceeds of this surcharge shall be separately
3 accounted for by the governing body of the municipality and
4 may be distributed quarterly only to fund residential traffic
5 calming programs.
6 Section 2. This act shall take effect upon becoming a
7 law
