  1                      A bill to be entitled

  2         An act relating to motor vehicle inspections;

  3         amending s. 325.206, F.S.; providing for the

  4         elimination of all motor vehicle emission

  5         testing in counties which have reached their

  6         required air attainment standards as required

  7         by the Department of Environmental Protection;

  8         providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Section 325.206, Florida Statutes, is

13  amended to read:

14         325.206  Exhaust emissions inspection criteria;

15  rules.--

16         (1)  The Department of Environmental Protection shall

17  adopt rules to establish, periodically evaluate, and revise

18  the uniform standards and criteria for the inspection of

19  exhaust emissions, including maximum allowable emissions

20  levels and emission capacity standards to be used in motor

21  vehicle inspection stations. Such standards and criteria shall

22  include, but are not limited to, exhaust emissions testing and

23  inspection procedures and the development of inspection pass

24  or fail criteria. Standards may vary by size, class, type, and

25  year of each motor vehicle engine and may not be more

26  stringent than those required by federal law at the time of

27  the manufacture of the motor vehicle. In establishing

28  standards and criteria, the Department of Environmental

29  Protection shall give consideration to levels of emissions

30  reduction that are necessary to achieve applicable federal and

31  state air quality standards.

  1         (2)  The Department of Environmental Protection shall

  2  adopt rules establishing the test procedures and test

  3  equipment to be used for the emissions inspection. Test

  4  procedures shall be capable of being conducted by the motor

  5  vehicle repair industry for purposes of pass or fail criteria

  6  of the emissions inspection. Test equipment used in the

  7  emissions inspection or comparable equipment shall be

  8  available to the motor vehicle repair industry in the open

  9  market.

10         (3)  Any other provision of law to the contrary

11  notwithstanding, when any county achieves the required air

12  attainment standards as required by the Department of

13  Environmental Protection, all vehicle emission testing as

14  required by this chapter or rules of the Department of

15  Environmental Protection shall be discontinued.

16         (4)(3)  The Department of Highway Safety and Motor

17  Vehicles shall enforce and administer the rules, standards,

18  and criteria provided for in this section.

19         Section 2.  This act shall take effect upon becoming a

20  law.
