  2         An act relating to research and development

  3         authorities; amending s. 159.703, F.S.;

  4         deleting requirements relating to membership of

  5         an authority affiliated with the National High

  6         Magnetic Field Laboratory; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Subsection (3) of section 159.703, Florida

12  Statutes, is amended to read:

13         159.703  Creation of research and development

14  authorities.--

15         (3)  The resolution shall designate not less than five

16  persons who are residents and electors of, or have their

17  principal place of employment in, the county as members of the

18  authority created for said county.  Of the members first

19  appointed, one shall serve for 1 year, one for 2 years, one

20  for 3 years, and the remainder for 4 years and in each case

21  until his or her successor is appointed and has qualified.

22  Thereafter, the board shall appoint for terms of 4 years each

23  a member or members to succeed those whose terms expire,

24  except that with respect to an authority that owns, occupies,

25  or maintains a research development park, as defined in s.

26  159.27(7), within which is located a substantial capital

27  project that is funded in whole or in part by the state, and

28  is a part of or directly affiliated with the National High

29  Magnetic Field Laboratory, the first two such vacancies that

30  occur on or after July 1, 1991, shall not be filled.  In

31  addition to the other members, the president of each

  1  affiliated institution of higher education, or the president's

  2  designee, shall be a member of the authority and shall serve

  3  ex officio; provided, further, that with respect to an

  4  authority that owns, occupies, or maintains a research

  5  development park, as defined in s. 159.27(7), within which is

  6  located a substantial capital project that is funded in whole

  7  or in part by the state, and is a part of or directly

  8  affiliated with the National High Magnetic Field Laboratory,

  9  the Chancellor of the State University System or the

10  Chancellor's designee, the Director of the National High

11  Magnetic Field Laboratory or the director's designee, one

12  resident of the county in which the research development park

13  is located appointed by the President of the Senate to serve

14  at the pleasure of the President of the Senate, and one

15  resident of the county in which the research development park

16  is located appointed by the Speaker of the House of

17  Representatives to serve at the pleasure of the Speaker of the

18  House of Representatives shall be members of the authority and

19  shall serve ex officio. Except as to members who serve ex

20  officio, the board shall fill any vacancy for an unexpired

21  term.  A member of the authority shall be eligible for

22  reappointment.  Any member of the authority may be removed by

23  the board for misfeasance, malfeasance, or willful neglect of

24  duty.  Each member of the authority before entering upon his

25  or her duties shall take and subscribe the oath or affirmation

26  required by the State Constitution.  A record of each such

27  oath shall be filed with the Department of State and with the

28  clerk of the circuit court.

29         Section 2.  This act shall take effect July 1, 2000.
