  1                      A bill to be entitled

  2         An act relating to education; amending s.

  3         236.08106, F.S.; requiring a school district

  4         with a school in grade category "F" to permit

  5         relocation of teachers with certain

  6         qualifications; authorizing the State Board of

  7         Education to identify additional qualifications

  8         of demonstrated mastery for teachers; providing

  9         for bonuses for certain teachers; authorizing

10         the commissioner to adopt rules; providing an

11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14

15         Section 1.  Subsection (5) is added to section

16  236.08106, Florida Statutes, to read:

17         236.08106  Excellent Teaching Program.--

18         (5)(a)  Each school district that contains a school in

19  grade category "F" shall develop a plan to encourage teachers

20  with demonstrated mastery in improving student performance to

21  remain at or transfer to that school. If a teacher whose

22  mastery has been formally recognized by the designation of

23  Teacher of the Year at the district or state level, or who is

24  certified by the National Board of Professional Teaching

25  Standards, requests assignment to a school with grade category

26  "F," the school board and the principal shall make every

27  practical effort to grant the request.

28         (b)  Effective July 1, 2000, a teacher who has attained

29  NBPTS certification or who has been designated district or

30  state Teacher of the Year is eligible for a bonus if he or she

  1  is assigned to teach at a failing school. This bonus in

  2  addition to any bonus received because of NBPTS certification.

  3         (c)  The State Board of Education may specify

  4  additional criteria for identifying teachers who are

  5  ineligible under paragraph (b) but who otherwise demonstrate

  6  mastery. Effective July 1, 2001, a teacher identified under

  7  this paragraph is eligible for a bonus if he or she transfers

  8  to a failing school or is teaching at such a school at the

  9  time mastery is determined. The Commissioner of Education

10  shall adopt rules prescribing the measures used to determine

11  the teaching mastery necessary to become eligible for a bonus

12  under this paragraph.

13         (d)  A teacher identified under this subsection and

14  assigned to a failing school is eligible for an annual bonus

15  for a maximum of 5 years at that school. If the teacher then

16  transfers to another failing school, he or she may earn a

17  bonus for an additional 5 years.

18         Section 2.  This act shall take effect upon becoming a

19  law.

      category "F" to relocate certain teachers. Authorizes the

      qualifications of demonstrated mastery for teachers.
