1 A bill to be entitled
2 An act relating to trust funds; re-creating the
3 Administrative Trust Fund within the Department
4 of Health without modification; carrying
5 forward current balances and continuing current
6 sources and uses thereof; amending s. 20.435,
7 F.S.; abrogating the future termination of the
8 trust fund; providing an effective date.

10 WHEREAS, the Legislature wishes to extend the life of
11 the Administrative Trust Fund within the Department of Health,
12 which is otherwise scheduled to be terminated pursuant to
13 constitutional mandate, and
14 WHEREAS, the Legislature has reviewed the trust fund
15 before its scheduled termination date and has found that it
16 continues to meet an important public purpose, and
17 WHEREAS, the Legislature has found that existing public
18 policy concerning the trust fund sets adequate parameters for
19 its use, NOW, THEREFORE,

21 Be It Enacted by the Legislature of the State of Florida:
22
23 Section 1. (1) The Administrative Trust Fund within
24 the Department of Health, FLAIR number 64-2-021, which is to
25 be terminated pursuant to Section 19(f), Article III of the
26 State Constitution on July 1, 2001, is re-created.
27 (2) All current balances of the trust fund are carried
28 forward, and all current sources and uses of the trust fund
29 are continued.
30 Section 2. Paragraph (a) of subsection (1) of section
31 20.435, Florida Statutes, is amended to read:

1 20.435 Department of Health; trust funds.--
2 (1) The following trust funds are hereby created, to
3 be administered by the Department of Health:
4 (a) Administrative Trust Fund.
5 1. Funds to be credited to the trust fund shall
6 consist of regulatory fees such as those pertaining to the
7 licensing, permitting, and inspection of septic tanks, food
8 hygiene, onsite sewage, Super Act compliance, solid waste
9 management, tanning facilities, mobile home and recreational
10 vehicle park inspection, other departmental regulatory and
11 health care programs, and indirect earnings from grants.
12 Funds shall be used for the purpose of supporting the
13 regulatory activities of the department and for other such
14 purposes as may be appropriate and shall be expended only
15 pursuant to legislative appropriation or an approved amendment
16 to the department's operating budget pursuant to the
17 provisions of chapter 216.
18 2. Notwithstanding the provisions of s. 216.301 and
19 pursuant to s. 216.351, any balance in the trust fund at the
20 end of any fiscal year shall remain in the trust fund at the
21 end of the year and shall be available for carrying out the
22 purposes of the trust fund.
23 3. The trust fund shall, unless terminated sooner, be
24 terminated on July 1, 2001.
25 Section 3. This act shall take effect November 4,
26 2000.
