  1                      A bill to be entitled

  2         An act relating to trust funds; re-creating the

  3         Department of Health Tobacco Settlement Trust

  4         Fund within the department without

  5         modification; carrying forward current balances

  6         and continuing current sources and uses

  7         thereof; amending s. 20.435(1)(g), F.S.;

  8         abrogating future termination of the trust

  9         fund; providing an effective date.

11         WHEREAS, the Legislature wishes to extend the life of

12  the Department of Health Tobacco Settlement Trust Fund within

13  the department, which is otherwise scheduled to be terminated

14  pursuant to constitutional mandate, and

15         WHEREAS, the Legislature has reviewed the trust fund

16  before its scheduled termination date and has found that it

17  continues to meet an important public purpose, and

18         WHEREAS, the Legislature has found that existing public

19  policy concerning the trust fund sets adequate parameters for

20  its use, NOW, THEREFORE,

22  Be It Enacted by the Legislature of the State of Florida:

23

24         Section 1.  (1)  The Department of Health Tobacco

25  Settlement Trust Fund within the department, FLAIR number

26  64-2-122, which is to be terminated pursuant to Section 19(f),

27  Article III of the State Constitution on July 1, 2002, is

28  re-created.

29         (2)  All current balances of the trust fund are carried

30  forward, and all current sources and uses of the trust fund

31  are continued.

  1         Section 2.  Paragraph (g) of subsection (1) of section

  2  20.435, Florida Statutes, is amended to read:

  3         20.435  Department of Health; trust funds.--

  4         (1)  The following trust funds are hereby created, to

  5  be administered by the Department of Health:

  6         (g)  Department of Health Tobacco Settlement Trust

  7  Fund.

  8         1.  Funds to be credited to the trust fund shall

  9  consist of funds disbursed, by nonoperating transfer, from the

10  Department of Banking and Finance Tobacco Settlement Clearing

11  Trust Fund in amounts equal to the annual appropriations made

12  from this trust fund.

13         2.  Notwithstanding the provisions of s. 216.301 and

14  pursuant to s. 216.351, any unencumbered balance in the trust

15  fund at the end of any fiscal year and any encumbered balance

16  remaining undisbursed on December 31 of the same calendar year

17  shall revert to the Department of Banking and Finance Tobacco

18  Settlement Clearing Trust Fund.

19         3.  The trust fund shall, unless terminated sooner, be

20  terminated on July 1, 2002.

21         Section 3.  This act shall take effect November 4,

22  2000.
