14         Amendment (with title amendment) 

15         On page 8, between lines 29 and 30,

17  insert:

18         Section 9.  Paragraph (e) of subsection (1) of section

19  627.411, Florida Statutes, is amended to read:

20         627.411  Grounds for disapproval.--

21         (1)  The department shall disapprove any form filed

22  under s. 627.410, or withdraw any previous approval thereof,

23  only if the form:

24         (e)1.  Is for health insurance, and provides benefits

25  which are unreasonable in relation to the premium charged; or,

26         2.  Contains provisions that constitute unfair

27  discrimination pursuant to s. 626.9541(1)(g), which are unfair

28  or inequitable or contrary to the public policy of this state

29  or which encourage misrepresentation, or which apply rating

30  practices which result in premium escalations that are not

31  viable for the policyholder market or result in unfair
