13         Amendment (with title amendment) 

14         Between page 3, line 31, and page 4, line 1, of the

15  bill

17  insert:

18         Section 3.  Subsection (7) of section 828.27, Florida

19  Statutes, is amended to read:

20         828.27  Local animal control or cruelty ordinances;

21  penalty.--

22         (7)  Nothing contained in this section shall prevent

23  any county or municipality from enacting any ordinance

24  relating to animal control or cruelty which is identical to

25  the provisions of this chapter or any other state law, except

26  as to penalty. However, no county or municipal ordinance

27  relating to animal control or cruelty shall conflict with the

28  provisions of this chapter or any other state law.

29  Notwithstanding the provisions of this subsection, the

30  governing body of any county or municipality is authorized to

31  enact ordinances prohibiting or regulating noise from any

 1  animal, violation of which shall be punishable upon conviction

 2  by a fine not to exceed $500 or by imprisonment in the county

 3  jail for a period not to exceed 60 days, or by both such fine

 4  and imprisonment, for each violation of such ordinance.

12         amending s. 828.27, F.S.; authorizing counties
