11  The Committee on Judiciary offered the following:

13         Amendment to Amendment (785949) 

14         On page 19, line 5, of the amendment

15

16  insert:

17         (15)  If at the end of the deferment period, the drawer

18  cannot redeem or pay in full in cash the amount due and owing

19  the deferred presentment provider, or if there are

20  insufficient available funds in the drawer's account, the

21  deferred presentment provider shall not deposit or present for

22  payment a check being held for deferred presentment before the

23  expiration of thirty days from the date of the deferred

24  presentment agreement.  The deferred presentment provider may

25  rely upon the representation of the drawer as to the

26  sufficiency of funds in the drawer's account.  No additional

27  fees or penalties shall be imposed on the drawer by virtue of

28  any misrepresentation made by the drawer as to the sufficiency

29  of funds in the drawer's account.  In no event shall any

30  additional fees be added to the amounts due and owing to the

31  deferred presentment provider.
