14 On page 96, between lines 20 and 21, of the bill

16 insert:
17 Section 87. Subsections (1) and (2) of section
18 464.008, Florida Statutes, are amended to read:
19 464.008 Licensure by examination.--
20 (1) Any person desiring to be licensed as a registered
21 nurse or licensed practical nurse shall apply to the
22 department to take the licensure examination. The department
23 shall examine each applicant who:
24 (a) Has completed the application form and remitted a
25 fee set by the board not to exceed $150 and has remitted an
26 examination fee set by the board not to exceed $75 plus the
27 actual per applicant cost to the department for purchase of
28 the examination from the National Council of State Boards of
29 Nursing or a similar national organization.
30 (b) Has provided sufficient information on or after
31 October 1, 1989, which must be submitted by the department for

1 a statewide criminal records correspondence check through the
2 Department of Law Enforcement.
3 (c) Is in good mental and physical health, is a
4 recipient of a high school diploma or the equivalent, and has
5 completed the requirements for graduation from an approved
6 program for the preparation of registered nurses or licensed
7 practical nurses, whichever is applicable, or its equivalent
8 as determined by the board by rule. Courses successfully
9 completed in a professional nursing program which are at least
10 equivalent to a practical nursing program may be used to
11 satisfy the education requirements for licensure as a licensed
12 practical nurse.
13 (d) Has the ability to communicate in the English
14 language, which may be determined by an examination given by
15 the department.
16 (2) Each applicant who passes the examination and
17 provides proof of graduation from an approved nursing program,
18 or its equivalent as determined by the board by rule, shall,
19 unless denied pursuant to s. 464.018, be entitled to licensure
20 as a registered professional nurse or a licensed practical
21 nurse, whichever is applicable.
