14         Senate Amendment (with title amendment) 

15         On page 140, between lines 14 and 15,

16

17  insert:

18         Section 82.  Paragraph (e) of subsection (5) section

19  408.039, Florida Statutes, is redesignated as paragraph (f)

20  and a new paragraph (e) is added to subsection (5) of that

21  section to read:

22         408.039  Review process.--The review process for

23  certificates of need shall be as follows:

24         (e)  A hospital may initiate or intervene in an

25  administrative proceeding involving the issuance or denial of

26  a certificate of need for an organ transplantation program

27  upon a showing that an established organ transplantation

28  program at the hospital will be substantially affected by the

29  issuance of the certificate of need to a competing program or

30  facility within the same service planning area delineated

31  under rules adopted by the Agency for Health Care
