18 Section 33. Effective upon becoming law, section 24 of
19 chapter 97-164, Laws of Florida, is amended to read:
20 Section 24. (1) Notwithstanding the provisions of
21 section 370.093(3), Florida Statutes, there is hereby
22 established a 5-year 3-year pilot program that allows for
23 participation by Saltwater Products License holders with purse
24 seine endorsements during the years 1995 or 1996 located in
25 the counties of Wakulla, Franklin, Gulf, Bay, Walton, and
26 Okaloosa. Priority shall be given to such Saltwater Products
27 License holders with landings in 1996 as recorded on Florida
28 DEP trip tickets of one or more of the following baitfish
29 species: Spanish sardines, cigar minnows, thread herring, chub
30 mackerel, anchovy, little tunny, menhaden, blue runner, and
31 ladyfish. No more than 7 such licenses shall be issued which

1 allow for and shall be limited to the following:
2 (a) These licenses shall be issued only for the use of
3 baitfish purse seines, not exceeding 600 yards in length, to
4 be used in the nearshore and inshore waters, modified to
5 employ solid tarpaulin material in conjunction with 500 square
6 feet of traditional seine mesh netting in the State of Florida
7 in and south of the counties of Wakulla, Franklin, Gulf, Bay,
8 Walton, and Okaloosa. Only one purse seine per license shall
9 be allowed.
10 (b) Each licensee shall post a bond of $50,000 payable
11 to the State of Florida as security to pay for any
12 environmental damage or cleanup of material caused by this
13 fishing gear of the licensee.
14 (2) The Marine Fisheries Commission shall establish
15 limits on annual harvest levels for the area, for each of the
16 baitfish species that are the subject of this section, based
17 on maintaining healthy scientific and biological levels of
18 stock abundance of those certain baitfish species by allowing
19 annual harvest of the baitfish species in the program area
20 limited by the Florida Marine Fisheries Commission not to
21 exceed 50 percent of the annual average of reported landings
22 which occurred over the 3 years prior to July 1, 1995.
23 Section 34. Section 42 of chapter 97-160, Laws of
24 Florida, is repealed.
25 Section 35. Except as otherwise provided herein, this
26 act shall take effect July 1, 2000.
