15 On page 62, of the bill, between lines 29 and 30,

17 insert:

19 (4) The complaint and all information obtained pursuant to
20 the investigation by the department shall be confidential and
21 exempt from the provisions of s. 119.07(1) until the
22 conclusion of the preliminary investigation of the complaint,
23 or until such time as the preliminary investigation ceases to
24 be active, or until such time as otherwise provided by s.
25 231.263(6). However, the complaint and all material assembled
26 during the investigation may be inspected and copied by the
27 certificateholder under investigation, or the
28 certificateholder's designee, after the investigation is
29 concluded, but prior to the determination of probable cause by
30 the commissioner. If the preliminary investigation, is
31 concluded with the finding that there is no probable cause to

1 proceed, the complaint and information shall be open
2 thereafter to inspection pursuant to s. 119.07(1). If the
3 preliminary investigation is concluded with the finding that
4 there is probable cause to proceed and a complaint is filed
5 pursuant to subsection (5), the complaint and information
6 shall be open thereafter to inspection pursuant to s.
7 119.97(1). If the preliminary investigation ceases to be
8 active, the complaint and all such material shall be open
9 thereafter to inspection pursuant to s. 119.07(1), except as
10 otherwise provided pursuant to s. 231.263(6)(d). For the
11 purpose of this subsection, a preliminary investigation shall
12 be considered active as long as it is continuing with a
13 reasonable, good faith anticipation that an administrative
14 finding will be made in the foreseeable future.
