2 An act relating to instructional personnel;
3 amending s. 230.23, F.S.; requiring each school
4 district with a school designated as
5 performance grade category "F" to permit
6 transfer of teachers with certain
7 qualifications; providing supplements for
8 certain teachers; requiring the Commissioner of
9 Education to adopt rules; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Paragraph (c) of subsection (16) of section
15 230.23, Florida Statutes, is amended to read:
16 230.23 Powers and duties of school board.--The school
17 board, acting as a board, shall exercise all powers and
18 perform all duties listed below:
19 (16) IMPLEMENT SCHOOL IMPROVEMENT AND
20 ACCOUNTABILITY.--Maintain a system of school improvement and
21 education accountability as provided by statute and State
22 Board of Education rule. This system of school improvement and
23 education accountability shall be consistent with, and
24 implemented through, the district's continuing system of
25 planning and budgeting required by this section and ss.
26 229.555 and 237.041. This system of school improvement and
27 education accountability shall include, but is not limited to,
28 the following:
29 (c) Assistance and intervention.--Develop a 2-year
30 plan of increasing individualized assistance and intervention
31 for each school in danger of not meeting state standards or

1 making adequate progress, as defined pursuant to statute and
2 State Board of Education rule, toward meeting the goals and
3 standards of its approved school improvement plan. A school
4 that is identified as being in performance grade category "D"
5 pursuant to s. 229.57 is in danger of failing and must be
6 provided assistance and intervention. Each school district in
7 which there is a school designated as performance grade
8 category "F" shall develop a plan to encourage teachers with
9 demonstrated mastery in improving student performance to
10 remain at or transfer to that school. If a classroom teacher,
11 as defined by s. 228.041(9)(a), who meets the definition of
12 teaching mastery developed according to the provisions of this
13 paragraph requests assignment to a school with grade category
14 "F," the school board and the principal shall make every
15 practical effort to grant the request. Effective July 1, 2001,
16 a classroom teacher whose effectiveness has been proven based
17 upon positive learning gains of his or her students as
18 measured by annual FCAT assessments pursuant to s. 229.57, is
19 eligible for an annual supplement of at least $1,000, as
20 provided for annually in the General Appropriations Act, each
21 year he or she teaches at a school designated as performance
22 grade category "F." In the absence of an FCAT assessment,
23 measurement of learning gains of students shall be as provided
24 in s. 229.57(12). The supplement received under this paragraph
25 shall be in addition to any supplement or bonus received
26 because of other local or state pay incentives based on
27 performance. The Commissioner of Education shall adopt rules
28 to determine the measures that define "teaching mastery" for
29 purposes of this paragraph. District school boards are
30 encouraged to prioritize the expenditures of funds received
31 from specific appropriation 110A of the General Appropriations

1 Act of fiscal year 1999-2000 to improve student performance in
2 schools that receive a performance grade category designation
3 of "D" or "F."
4 Section 2. This act shall take effect July 1, 2000.
