1 A bill to be entitled
2 An act relating to public servants; amending s.
3 836.10, F.S.; providing penalties for
4 threatening a public servant with death or
5 bodily injury; providing an effective date.

7 Be It Enacted by the Legislature of the State of Florida:

9 Section 1. Section 836.10, Florida Statutes, is
10 amended to read:
11 836.10 Written threats to kill or do bodily injury;
12 written threats to public servants; punishment.--
13 (1) Except as provided in subsection (2), if any
14 person writes or composes and also sends or procures the
15 sending of any letter or inscribed communication, so written
16 or composed, whether such letter or communication be signed or
17 anonymous, to any person, containing a threat to kill or to do
18 bodily injury to the person to whom such letter or
19 communication is sent, or a threat to kill or do bodily injury
20 to any member of the family of the person to whom such letter
21 or communication is sent, the person so writing or composing
22 and so sending or procuring the sending of such letter or
23 communication, shall be guilty of a felony of the second
24 degree, punishable as provided in s. 775.082, s. 775.083, or
25 s. 775.084.
26 (2) If any person writes or composes and sends or
27 transmits or procures the sending or transmission of any
28 letter, inscribed communication, or electronic communication,
29 whether such letter or communication be signed or anonymous,
30 to any public servant, as defined in s. 838.014(4), containing
31 a threat to kill or to do bodily injury to the public servant

1 to whom such letter or communication is sent, or a threat to
2 kill or do bodily injury to any member of the family of the
3 public servant to whom such letter or communication is sent,
4 the person who wrote or composed and who sent or transmitted
5 or procured the sending or transmission of such letter or
6 communication shall be guilty of a misdemeanor of the first
7 degree, punishable as provided in s. 775.082 or s. 775.083.
8 Section 2. This act shall take effect October 1, 2000.
