  1                      A bill to be entitled

  2         An act relating to eminent domain; amending s.

  3         166.411, F.S.; providing an additional purpose

  4         for which a municipality may exercise the power

  5         of eminent domain; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsections (9) and (10) of section

10  166.411, Florida Statutes, are amended, and subsection (11) is

11  added to said section to read:

12         166.411  Eminent domain; uses or

13  purposes.--Municipalities are authorized to exercise the power

14  of eminent domain for the following uses or purposes:

15         (9)  For laying wires and conduits underground; and

16         (10)  For city buildings, waterworks, ponds, and other

17  municipal purposes which shall be coextensive with the powers

18  of the municipality exercising the right of eminent domain;

19  and

20         (11)  For obtaining lands to be conveyed by the

21  municipality to the school board of the school district for

22  the county within which the municipality is located, if the

23  school board requests, in writing, that the municipality

24  obtain such lands for conveyance to the school board and

25  promises to use its best efforts to establish a public school

26  thereon. Fulfilling the purpose of this subsection is hereby

27  recognized as constituting a valid municipal public purpose.

28         Section 2.  This act shall take effect upon becoming a

29  law.

      Provides that a municipality may exercise the power of
  4    eminent domain for obtaining lands to be conveyed by the
      municipality to the school board, if the school board
  5    requests, in writing, that the municipality obtain such
      lands for conveyance to the school board to establish a
  6    public school on such land.
