1 A bill to be entitled
2 An act relating to institutional child abuse or
3 neglect; amending s. 39.01, F.S.; revising the
4 definition of "institutional child abuse or
5 neglect" to include situations of abuse or
6 neglect in which the alleged perpetrator is an
7 employee of a district school board; revising
8 the definition of "other person responsible for
9 a child's welfare" to include an employee of a
10 district school board; providing an effective
11 date.

13 Be It Enacted by the Legislature of the State of Florida:

15 Section 1. Subsections (32) and (48) of section 39.01,
16 Florida Statutes, are amended to read:
17 39.01 Definitions.--When used in this chapter, unless
18 the context otherwise requires:
19 (32) "Institutional child abuse or neglect" means
20 situations of known or suspected child abuse or neglect in
21 which the person allegedly perpetrating the child abuse or
22 neglect is an employee of a district school board, private
23 school, public or private day care center, residential home,
24 institution, facility, or agency or any other person at such
25 institution responsible for the child's care.
26 (48) "Other person responsible for a child's welfare"
27 includes the child's legal guardian, legal custodian, or
28 foster parent; an employee of a district school board, private
29 school, public or private child day care center, residential
30 home, institution, facility, or agency; or any other person
31 legally responsible for the child's welfare in a residential

1 setting; and also includes an adult sitter or relative
2 entrusted with a child's care. For the purpose of departmental
3 investigative jurisdiction, this definition does not include
4 law enforcement officers, or employees of municipal or county
5 detention facilities or the Department of Corrections, while
6 acting in an official capacity.
7 Section 2. This act shall take effect upon becoming a
8 law.
