  2         An act relating to tattooing; amending s.

  3         877.04, F.S.; providing an additional

  4         restriction with respect to the tattooing of

  5         minors; requiring a sunrise review to be

  6         conducted to determine the need to regulate the

  7         tattooing industry; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Subsection (3) of section 877.04, Florida

13  Statutes, is amended to read:

14         877.04  Tattooing prohibited; penalty.--

15         (3)  No body of a minor shall be tattooed without the

16  written notarized consent of the parent or legal guardian. No

17  body of a minor under the age of 16 shall be tattooed unless

18  the minor is accompanied by a parent or legal guardian.

19         Section 2.  Tattooing industry sunrise review.--It is

20  the intent of the Legislature that no profession or occupation

21  be subject to regulation by the state unless the regulation is

22  necessary to protect the public health, safety, or welfare

23  from significant and discernible harm or damage. Therefore,

24  pursuant to s. 11.62, Florida Statutes, a sunrise review shall

25  be conducted to determine the need to regulate the tattooing

26  industry. The recommendations of the review shall be submitted

27  to the Legislature on or before February 1, 2001. The

28  proponents of this regulation and the agency of jurisdiction

29  shall assist in conducting the review.

30         Section 3.  This act shall take effect July 1, 2000.
